Shopper sues owner of shopping mall garage, alleging damages of up to $75,000

CHARLESTON — A Charleston Town Center Mall shopper is suing ABM Industry Groups, owner of the mall's parking garage, after allegedly slipping on the stairs of the parking garage.

Hicks Blakenship filed the complaint in Kanawha Circuit Court, against ABM Industry Groups LLC, alleging negligence and failure to warn.

Blakenshop claims that the defendant failed to exercise reasonable care in the maintenance of the stairs of the parking garage for patrons to come and go safely.

Blakenship claims he slipped and fell on a "foreign substance," according to the Feb. 9, 2017, lawsuit. 

Plaintiff claims a foreign substance remained on the steps while he was exiting the mall after parking his vehicle on the parking garage owned, operated and maintained by defendant ABM. 

As a result, Blakenship claims he sustained physical injuries, aggravation, inconvenience and medical expenses. 

The plaintiff holds ABM Industry Groups LLC responsible, because the defendant allegedly failed to maintain premises in a safe condition and failed to warn customers to the dangerous condition in the parking garage.

The plaintiff requests a trial by jury and seeks judgment for damages, court costs, and prejudgment interest, and other relief to which may be deemed entitled and is determined to just and equitable. He is represented by Greg K. Smith of Law Office of Greg K. Smith in Williamson.
