Lumber company alleges contractors owe $4,500

RIPLEY — An Ohio lumber company is suing Jackson County contractors, alleging they owe more than $4,5000 for breach of a contractual and guaranty agreement.

The Carter-Jones Lumber Company, doing business as Carter Lumber, filed a complaint in Jackson Circuit Court against Casey Construction LLC and Kohn C. Casey, alleging failure to perform their contractual obligations.

According to the complaint, on June 17, 2015, Carter Lumber agreed to sell materials and supplies to Casey Construction on credit. After exerting all efforts to collect payments, the suit says, the principal amount of $3,554.08 remains unpaid, plus finance charges and attorney fees. 

The plaintiff alleges Casey Construction and Kohn Casey have failed and refused to make full payments for the materials and supplies they purchased.

Carter Lumber seeks trial by jury, judgment of $4,503.08, plus interest, court costs, attorney fees and all other just and appropriate relief. It is represented by attorney Mary K. Prim of Scott Depot.
