Former Pratt property owners allege sewage system operators' negligence caused damage

CHARLESTON — Two former Pratt residents are suing Pratt sewage system operators, alleging breach of duty.

William E. Wright and Angela Cooper, who had lived in their residence for about 40 years, filed a complaint in Kanawha Circuit Court against the town of Pratt and the Kanawha Public Service District, alleging failure to remove sewage from the plaintiffs' dwelling and other residences without delay.

According to the complaint, on Jan. 23, 2016, sewage waste backed up into the to plaintiffs' dwelling, 204 Campbell Ave., Pratt, causing damage to their finished basement and personal property. The suit says the sewage contained foul water, foul odor, harmful bacteria and eventually mold and mildew. 

The plaintiffs allege the defendants breached their duties to operate the sewage system in a safe and proper fashion.

Wright and Cooper seek trial by jury, damages that will fully and fairly compensate them, pre-judgment interest, attorney fees, costs and all other fit and proper relief. They are represented by attorney Alan L. Pritt of Pritt & Spano PLLC in Charleston.
