Wheeling couple alleges CVS failed to provide proper security protection

WHEELING — A Wheeling couple is suing CVS, alleging breach of duty and negligence.

Jean Marie Romanek and John Paul Romanek filed a complaint in Ohio Circuit Court against West Virginia CVS Pharmacy, alleging the store failed to keep premises safe so as not to endanger the safety of CVS shoppers.

According to the complaint, May 28, 2017, the Romaneks approached the entrance of the CVS store, 842 National Road, Wheeling from the parking lot area. The suit says Jean Marie Romanek was struck by a shoplifter who was being actively pursued by defendants' personnel. 

Romanek allegedly was struck and violently knocked to the ground, suffering serious internal injuries that required immediate medical attention and will likely lead to medical expenses and future lost wages. 

The plaintiffs allege West Virginia CVS Pharmacy failed to ensure that attempted apprehensions and detentions were done in a reasonable manner and without endangering the safety of CVS shoppers.

The Romaneks seek trial by jury, compensatory and punitive damages, court costs, plus pre- and post-judgment interest on all amounts. They are represented by attorneys Scott S. Blass and Meaghan L. Tague of Bordas & Bordas PLLC in Wheeling.
