CHARLESTON — A widower, who is an estate executor, is suing LabCorp, also known as Laboratory Corp. of America Holdings, alleging wrongful conduct in a case involving his wife's cause of death.
Alexander Righter Conner filed the complaint in Kanawha Circuit Court, alleging tortious interference against Laboratory Corp. of America Holding.
Conner claims that the Delaware corporation failed to provide his late wife's medical records. He alleges the company breached its duty of good faith and fair dealings.
Conner alleges that he suffered damages after the defendants allegedly kept him from obtaining a certificate of merit as required by the West Virginia Medical Professionals Liability Act. The plaintiff is seeking to have a physician review the medical records, according to the complaint.
He claims Laboratory Corp. has refused to release slides of tissue samples of his deceased wife, Crystal Faye Cash, to determine the cause of her death and other matters related to her death on Sept. 9, 2016.
The plaintiff holds Laboratory Corp. of America Holdings responsible, because the defendant allegedly refused to produce the requested medical records and slides, and obligated plaintiff to retain attorneys to prosecute action.
The plaintiff requests a trial by jury and seeks judgment against defendant, copy of the slides, attorneys' fees, costs of action, and other relief as the court deems just.
