HUNTINGTON — A Cabell County customer is suing the manufacturer and dealer of a Dodge Ram 1500, alleging breach of warranty.
William H. Richie filed a complaint in Cabell Circuit Court against FCA US LLC and Goldy Auto LLC, alleging they obtained profit through unfair or deceptive trade or commerce.
According to the complaint, on Sept. 18, 2017, Richie bought a new Dodge Ram 1500 ST for $38,261.25 from Goldy Auto. The suit says Richie has been hurt by the unlawful conduct of the defendants in manufacturing and selling a defective new Dodge Ram 1500 and their failure to effectively repair the vehicle when necessary. The suit alleges Richie has suffered annoyance, inconvenience, and incurred expenses for alternative transportation.
The plaintiff alleges FCA US and Goldy Auto failed to conform the new vehicle to warranty or replace the Dodge Ram 1500 with a new vehicle after several attempts to remedy the defects.
Richie seeks trial by jury, damages, costs of repair, replacement transportation, attorney fees and costs, and all further just relief. He is represented by attorney Larry O. Ford of Meyer, Ford & Glasser PLLC in Charleston.
