Couple alleges Beckley company's negligence caused injuries to husband

BECKLEY — A Raleigh couple is suing a West Virginia corporation, alleging negligence caused injuries to the husband.

Charles Mills and Debbie Mills filed a complaint in Raleigh Circuit Court against NPW Development Corporation, alleging the defendant allowed unsafe working conditions in the workplace that presented a high degree of risk and strong probability of serious injury.

According to the complaint, on June 29, 2016, Charles Mills was working as an employee of NPW when he was directed by his employer to construct and then work from a temporary elevated platform while building a porch on a residential dwelling. However, while working without fall protection, the suit says, the temporary platform gave way causing Mills to fall to the ground from a height in excess of 6 feet. 

As a result, Mills said he suffered a serious compensable injury, including a broken right open talus bone and a dislocated ankle. The suit says this deprived his wife Debbie Mills of the society, companionship and services of her husband. 

The plaintiffs allege NPW Development failed to warn of the unsafe working conditions, causing serious injury arising from the temporary elevated platform.

Charles and Debbie Mills seek trial by jury, judgment for losses and damages, plus pre- and post-judgment interest, attorney fees, costs, plus all further just relief. They are represented by attorneys Robert B. Warner, Lynnette Simon Marshall and Andrew D. Byrd of Warner Law Offices in Charleston.
