Maryland business alleges HVAC contractor owes $6,300

BECKLEY — A Maryland heating distributor company is suing a Beaver HVAC contractor, alleging breach of contract and unjust enrichment.

R.E. Michel Company LLC of Glen Burnie, Maryland, filed a complaint in Raleigh Circuit Court against Laxton Enterprises Inc., doing business as All Kool Heating, Air Conditioning & Electric, alleging the defendant failed to pay more than $6,300 for goods received.

According to the complaint, R.E. Michel sold to All Kool certain goods in the amount and for the prices set forth in invoice statements of the defendant's account taken from its books and records. 

R.E. Michael Plaintiff says it has performed all conditions required under the contract but has failed to receive payment amounting to $6,339.66 with an interest rate of 18 percent per annum to the past due balance dating from Feb. 2. 

The plaintiff alleges All Kool Heating, Air Conditioning & Electric has failed or refused to pay the $6,339.66 for the goods received and continues to retain the benefit of the goods without paying fair compensation.

R. E. Michael seeks trial by jury, damages of $6,339.66 together with the continually accruing interest charge at the statutory rate of 7 percent per annum from Feb. 2, costs of suit and all other just relief. It is represented by attorney John R. Keating of Amato Keating and Lessa PC in Bethlehem, Pennsylvania.
