Couple sues Countryside Camping trailer park in golf cart dispute

GRAFTON — A couple is alleging "wrongful eviction" from Countryside Camping, after the trailer park operator allegedly objected to their golf cart.

Brian Patton and Jody Farnsworth filed a complaint in Taylor Circuit Court against Countryside Camping LLC, also known as Lakeside Resort campground, a trailer park operator. The plaintiffs, who lived at the trailer park from 2009 until their eviction in 2018, allege breach of duty, negligence, misrepresentation, and wrongful eviction.

The plaintiffs allege that they spent thousands of dollars over the years to maintain and upgrade their campsite. They claim they have suffered monetary damages, annoyance, inconvenience, humiliation, harassment and other damages, as a result of the unlawful and malicious conduct of the defendants in seeking to enforce "arbitrary, capricious and vague policies, including failing to provide notice of acceptable conduct and wrongful eviction from tenancy."

The plaintiffs allege they were falsely accused of using a golf cart that is not a standard golf cart. The plaintiffs' golf cart was a 2008 Club Car Golf Cart.

The plaintiffs hold Countryside Camping responsible because the defendant allegedly failed its duty to maintain leased property in an applicable healthy and safe condition, and wrongfully accused plaintiffs of violating campground rules, improper behavior and disorderly conduct.

The plaintiffs request a trial by jury and seek judgment against defendants for compensatory damages, attorney's fees, interest, and further relief as the court deems just. They are represented by Charles R. Steele of Steele Law Offices in Clarksburg.
