CHARLESTON, WVA — A staffing services company is suing Brittanie Starcher and Mountaineer Employment Solutions LLC, former employee and competitor company, citing alleged breach of non-solicitation agreement and tortious interference.
United Talent LLC filed the complaint in Kanawha Circuit Court against the defendants alleging that they breached their duties of good faith and fair dealings.
The plaintiff alleges that on April 9 United Talent LLC caused irreparable damage to customer relations and significant financial loss, as a result of the malicious and intentional conduct of the defendants.
The plaintiff alleges that the defendants interfered with its business relationships and expectancies by using plaintiff's confidential business information to solicit businesses for defendants' own profit, in violation of a non-solicitation agreement Starcher had previously signed.
The plaintiff holds Brittanie Starcher and Mountaineer Employment Solutions, responsible because the defendants allegedly utilized plaintiff's confidential information and trade secrets, failed to abide by the non-solicitation agreement, and harmed plaintiff's business, profit and reputation,.
The plaintiff requests a trial by jury and seeks judgment against defendants for compensatory and punitive damages, attorneys' fees, costs, and further relief as the court deems just. They are represented by Christopher L. Slaughter of Steptoe & Johnson PLLC in Huntington.
