Camden Park customer alleges negligence caused her to be ejected from ride

HUNTINGTON — A Mingo County woman is suing a Huntington amusement park operator, alleging insufficient measures were taken to prevent injuries.

Wendy Fitch filed a complaint in Cabell Circuit Court against Waverly Entertainment Inc., doing business as Camden Park Inc., and Brass Ring Inc. Corporation, alleging they failed to protect the safety of their customers, leading to bodily injury.

According to the complaint, on July 3, 2016, Fitch was preparing to ride the "Flying Scooter" at Camden Park when the defendants' employees failed to securely strap her in the ride. The suit says this caused a part of her ride to fly around and hit her, ejecting her from the ride and causing numerous serious injuries leading to more than $100,000 in medical expenses. 


The plaintiff alleges Camden Park and Brass Ring failed to properly employ, instruct, train, manage and supervise their employees and failed to provide emergency care to Fitch, causing delay in treatment.

Fitch seeks trial by jury, judgment necessary to compensate for damages suffered, pre- and post-judgment interest at 18 percent per annum, court costs, expenses, attorney fees and all other just relief. She is represented by attorney Justin J. Marcum of Williamson.
