Logan County resident alleges gas pipeline operators failed to maintain lines

LOGAN — A Logan County man is suing gas pipeline operators, alleging negligence led to an explosion that injured the plaintiff.

Dennis Osborne Jr. filed a complaint in Logan Circuit Court against Beara Gas Company and/or John Doe Entities 1-10, and Randall McNew and/or John Does 1-10, alleging they failed to follow applicable safety guidelines and regulations.

According to the complaint, on June 30, 2016, while Osborne was on a property in Logan County owned by a relative a gas leak caused an explosion. Osborne says he sustained physical injuries, pain and suffering, mental pain, loss of enjoyment of life, medical expenses, lost wages, disfigurement, impairment, and reduced ability to earn income. 

The suit says unknown to Osborne and the homeowner, the defendants were negligent in the maintenance of the gas transmission lines within their property so that the pipeline was leaking a hazardous and combustible gas, causing the explosion.  

The plaintiff alleges the defendants failed to timely and adequately inspect, maintain, operate or repair the pipelines, and failed to protect Osborne and others from injuries due to defective pipelines.

Osborne seeks trial by jury judgment to fully compensate the plaintiff for his damages and injuries, plus costs, interests, and attorney fees. He is represented by attorneys Matthew P. Stapleton and Scott G. Stapleton of Stapleton Law Offices in Huntington.
