Personnel management corporation alleges trucking business owes $13,000

Lawsuits

CHARLESTON — A personnel management business is suing a Kermit trucking business, alleging breach of contract and unjust enrichment in its failure to pay more than $13,000.

Professional Payroll Concepts, doing business as Personnel Management of WV, filed a complaint in Kanawha Circuit Court against Kirk Trucking Co. Inc., alleging failure to perform under the agreement.

According to the complaint, on Feb. 1, 2004, Kirk Trucking, under its alter ego PJK Enterprise entered into a client service agreement with Personnel Management for the administration of the defendant's benefits. To date, the suit says, Kirk Trucking owes the plaintiff $13,370.71, for the services provided between July 1, 2016 and Feb. 28, 2017. 

The plaintiff alleges Kirk Trucking has failed to pay plaintiff's services.

Personnel Management of WV seeks trial by jury, compensatory damages of $13,370.71, with interest, costs, attorney fees and all other just and proper relief. It is represented by attorney Patrick C. Timony of Bowles Rice LLP in Charleston.
