Hope Clinic blamed for patient's overdose death from oxycodone

CHARLESTON — An estate administratrix is suing Hope Clinic PLL, et al., healthcare providers, citing alleged negligence.

Inez Lewis, individually and as administratrix of the estate of Timothy Jason Lewis, filed a complaint in Kanawha Circuit Court against the defendants alleging that they violated the West Virginia Professional Liability Act.

According to the complaint, the plaintiff alleges that, beginning in 2014, Lewis was under the care of the defendants. As a result of their negligent acts and omissions, he became addicted to opioids, his health deteriorated and he was unable to maintain gainful employment. He died on May 4, 2017 due to an overdose of opioids.

The plaintiff holds Hope Clinic et al. responsible because they allegedly negligently deviated from the standards of care by prescribing Lewis oxycodone and methadone HCL, which were medically unnecessary.

The plaintiff requests a trial by jury; and seeks a judgment against the defendants in an amount exceeding the minimum jurisdiction of the court, with interest, attorney's fees and costs. She is represented by Kathy A. Brown and Timothy D. Houston of Brown Houston PLLC in Charleston.
