Ohio couple alleges bridge contractors' negligence injured husband

MOUNDSVILLE — An Ohio couple is suing bridge contractors, alleging negligence and strict product liability.

Ora R. Graham and Tammy P. Graham of Powhatan Point, Ohio, filed a complaint in Marshall Circuit Court against Jeff's Welding & Machine LLC, Brian Hughes, doing business as Hughes Construction and Strata Mine Services LLC, alleging they breached their duty to keep the Marshall County Mine in a reasonably safe condition.

According to the complaint, on May 2, 2017, Ora Graham, a coal mine employee, was carrying supplies across an overcast bridge at the Marshall County Mine. The suit says he was injured when one or more of the bridge support brackets collapsed, causing him to fall more than 12 feet. Graham says he received injuries to his leg, foot, knee and back. 

The plaintiffs allege the defendants failed to properly design, fabricate and maintain all support brackets of the bridge in compliance with all applicable laws and regulations.

The Grahams seek trial by jury, compensatory and punitive damages, pre- and post-judgment interest, attorney fees, court costs and expenses and all other just and proper relief. They are represented by attorney J. Zachary Zatezalo of Bordas & Bordas PLLC in Wheeling.
