Ambulance service alleges Marshall County Commission breached contract

MOUNDSVILLE — An emergency service provider is suing Marshall County officials, alleging breach of contract.

Tri-State Ambulance Inc. filed a complaint in Marshall Circuit Court against the Marshall County Commission and Emergency Site Protection LLC, alleging illegally canceled a contract..

According to the complaint, on March 31, 2013, the commission gave Tri-State Ambulance exclusive right to provide ambulance services in Marshall County, 24 hours a day, seven days per week. 

However, the suit says, the commission failed to timely provide notice of cancellation of the contract, wrongfully hired Emergency Site Protection to provide ambulance services every other day and began purchasing its own ambulance vehicles to prevent the plaintiff from offering exclusive services.

Tri-State Ambulance seeks trial by jury, compensatory and punitive damages, plus interest, costs, attorney fees and all other appropriate relief. It is represented by Paul J. Harris of Harris Law Offices in Wheeling.
