Weirton property owner alleges deli company owes $22,000 for back rent

NEW CUMBERLAND — A Weirton property owner is suing a deli business, alleging it owes more than $22,000 for refusal to apply payments.

Barone Realty Service Co. filed a complaint in Hancock Circuit Court against Jackson-Barrett Deli, LLC and Douglas Jackson, alleging they breached the written lease agreement by failing to pay rent and other amounts due and owing.

According to the complaint, on June 1, 2015, Barone Realty Service entered into a written lease wherein Jackson-Barrett Deli would rent at the commercial building, 3815 Brighthway, Wierton. However, the suit says, since February 2017 Barone has failed to receive payments for rents, fees and taxes amounting to $22,286.34.

The lawsuit states the defendants changed the condition of real property, causing it to be damaged and decreased in value. 

The plaintiff alleges Jackson-Barrett Deli and Douglas Jackson have failed and refused to pay rents, fees, and taxes required under the lease agreement as well as changing the condition of the property, resulting in damages and decrease in value.

Barone Realty Service seeks trial by jury, judgment of $22,866.34, plus pre- and post-judgment interest, as well as compensatory damages in a sum sufficient to make the plaintiff whole. It is represented by attorney Michael Edward Nogay of Sellitti, Nogay & McCune PLLC in Weirton.
