Customer alleges Lowe's Homer Center negligence caused large rug to fall on her

CHARLESTON — A Kanawha County woman is suing Lowe's Home Centers, alleging insufficient measures were taken to prevent injuries to the plaintiff.

Mary C. Smith-Wilson filed a complaint in Kanawha Circuit Court against Lowe's Home Centers LLC, alleging the home improvement store failed to examine the premises of its South Charleston facility for unsafe or dangerous conditions.

According to the complaint, on Nov. 10, 2016, Smith-Wilson was a Lowe's patron lawfully walking along or upon defendant's premises, near the inside fixture displays of various merchandise at 50 RHL Blvd., South Charleston. The suit says a large rug abruptly fell from an unsecured bin, striking Smith-Wilson's head, neck and shoulder before rolling onto the floor in the middle of the aisle. 

As a result, Smith-Wilson said, she suffered bodily injury, causing pain, disability and loss of capacity for the enjoyment of life. The plaintiff alleges Lowe's Home Centers failed to maintain proper control over the merchandise displayed in the large area of rugs while customers were entering the premises to conduct business.

Smith-Wilson seeks trial by jury, compensatory and punitive damages, pre- and post-judgment interest, attorney fees and all other just and appropriate relief. She is represented by attorney Clayton G. Anderson of The Masters Law Firm LC in Charleston.
