CHARLESTON — A West Virginia man is suing a debt collector, alleging violation of the the Telephone Consumer Protection Act.
Jeffery Clark filed a complaint in U.S. District Court for the Southern District of West Virginia against ARC Management Group LLC alleging that the debt collector violated TCPA through intrusive and unwanted calls.
According to the complaint, Clark was inconvenienced, harassed, bothered, angered, and caused indignation and distress, as a result of ARC's repeated calls to collect on an alleged debt. The suit says the calls came at inconvenient times in an attempt to annoy and abuse Clark while illegally utilizing an automatic telephone dialing system or artificial recorded voice.
The plaintiff alleges ARC Management Group attempted to collect a debt by coercion, and invaded Clark's privacy by placing calls at inconvenient times and without his express consent.
Clark seeks trial by jury, actual, statutory, compensatory and punitive damages, injunctive relief and all other just relief. He is represented by attorneys Ralph C. Young, Christopher B. Frost and Steven R. Broadwater Jr. of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville.
