Moundsville widow alleges memorial service providers breached contract

MOUNDSVILLE — A Moundsville widow is suing memorial service providers, alleging breach of contract and negligence.

Constance L. Thayer filed a complaint in Marshall Circuit Court against Moreland Burial Vault Company and/or Moreland Vault Company LLC, alleging they failed to install a memorial headstone in a workmanlike manner.

According to the complaint, on April 12, 2017, Thayer contracted the defendants for the engraving and installation of a memorial headstone for her late husband, Delno Thayer, who died April 1, 2017.. The suit says the defendants failed to engrave and to provide memorial headstone in a timely manner. 

Thayer says as a result of the defendants' reckless conduct, she suffered serious psychic and emotional injury. 

Thayer seeks trial by jury, damages in excess of $75,000, punitive damages, with interest, court costs and all other just and proper relief. She is represented by attorney Shane M. Mallett of Mallett Law Offices in Wheeling.
