Glen Dale homeowners allege county water system manager ruined property

MOUNDSVILLE — A Glen Dale mother and daughter are suing the local water and sewage system manager, alleging breach of duty and negligence.

Mary Ann Nolte and Lori Ann Marcinek filed a complaint in Marshall Circuit Court against Marshall County Public Service District No. 1, alleging failure to properly maintain its water system.

According to the complaint, on March 30, Nolte and Marcinek were residing at 19 Muldrew Drive, Glen Dale, when the county water main under Grandview Road failed, flooding the plaintiffs' front yard and basement. The suit says they suffered damages in excess of $51,812.28. 

The plaintiffs allege Marshall County Public Service District No. 1 failed to operate its water line pipes near the plaintiffs' residence in a safe and workmanlike manner.

Nolte and Marcinek seek trial by jury, damages to be determined by jury, plus court costs, interest and fees and all other relief permitted by law. They are represented by attorney Paul J. Harris of Wheeling.
