Ohio County property owner accuses Chesapeake Appalachia of reckless conduct

WHEELING — An Ohio County business property owner is suing an Oklahoma-based company, alleging breach of contract, negligence and reckless conduct.

Relyks LLC filed a complaint in Ohio Circuit Court against Chesapeake Appalachia LLC of Oklahoma City and SWN Production Company LLC of Spring, Texas, alleging failure to follow applicable safety guidelines and regulations.

According to the complaint, Relyks' property, including the mobile home park in the Richland County District in Ohio County that was adjacent to a portion of land was leased to the defendants under an oil and gas lease. On Nov. 21, 2012, the suit says, the property suffered damages because of the water, sludge and debris from the construction of the pad site known as the Howard Shackelford OHI pad. 

As a result of the defendants' breach of the lease agreement, Relkys says it has suffered loss of income from renters, diminution in value of the 8.517 acres outside the pad, loss of the use of the property, damage to a paved road and damage to the plaintiff's reputation. 

The plaintiff alleges Chesapeake Appalachia and SWN Production breached terms of the agreement by negligently constructing the pad site and failing to take steps to minimize the pad's disturbance to the remainder of plaintiff's property.

Relyks seeks trial by jury, compensatory and punitive damages, attorney fees and court costs, plus all further just relief. It is represented by attorney Eric M. Gordon of Berry, Kessler, Crutchfield, Taylor and Gordon in Moundsville.
