PRINCETON — A patient is suing a Mercer County doctor, alleging negligence during surgery after a vehicle crash.

Amanda Pitts filed a complaint in Mercer Circuit Court against Dr. Gary Patrick McCarthy, alleging the defendant breached professional standards of care and treatment.

According to the complaint, on April 29, 2017, Pitts was involved in a vehicle accident involving an ATV in McDowell County. The suit said she had surgery performed one day later at Bluefield Regional Medical Center by McCarthy and she was discharged May 2. 

The suit alleges Pitts was found to have a significant malreduction of her fracture just 10 days after the negligent surgery performed by McCarthy. The lawsuit states this caused Pitts to suffer permanent physical injury, pain, loss of enjoyment of life, and incur medical and other expenses. 

The plaintiff alleges McCarthy failed to properly reduce and secure Pitts' left hip fracture, depriving her of a greater chance of recovery and increasing her risk of harm.

Pitts seeks compensatory damages, interest, and all other just relief. She is represented by attorneys Mark R. Staun of Hartley Law Group PLLC in Charleston, and by Eric J. Buckner of Katz Kantor Stonestreet & Buckner PLLC in Princeton.
