CHARLESTON — A Dunbar woman is suing a loan servicer, alleging fraud.
Angel Mosley filed a complaint in Kanawha Circuit Court against Citifinancial Inc. and Bayview Loan Servicing LLC, alleging fraud regarding a loan.
According to the complaint, Mosley who is retired, disabled and unsophisticated in financial matters, alleges she has suffered economic loss, worry and stress, annoyance and inconvenience, and fear of loss of home, as a result of the defendants' unlawful conduct to induce her into a loan that exceeded the fair market value of her home in the Finney Branch neighborhood.
The plaintiff alleges Citifinancial and Bayview Loan Servicing failed to honor the loan agreement, and inflated the appraisal to induce Mosley into a loan that far exceeded the value of her property.
Mosley seeks trial by jury, equitable relief, actual and punitive damages, attorney fees, costs of litigation and all other just relief. She is represented by attorneys Loree Stark and Daniel F. Hedges of Mountain State Justice Inc. in Charleston.
