Trip, fall prompts lawsuit against Kroger supermarket

WINFIELD — A Putnam County woman accused a supermarket chain of negligence in a recent civil action.

Frances Burgess filed a complaint in Putnam Circuit Court against Kroger Group Cooperative Inc. and Kroger Limited Partnership.

According to the complaint, the plaintiff tripped on a pallet guard and fell at defendants' store in Scott Depot. She suffered a laceration to her left wrist and shoulder, the complaint states. The plaintiff accuses the defendants of failing to warn her of the dangerous condition of the floor. She is suing for pain and suffering, lost wages, annoyance, aggravation and mental anguish. 

The plaintiff requests a trial by jury and seeks special, general and punitive damages, interest, costs of action, and further relief as deemed just. She is represented by Kevin P. Davis in Charleston.
