HUNTINGTON – A Huntington patient alleges he was injured in a 2010 foot surgery.
Roy Don Baker filed a complaint in Cabell Circuit Court against Kevin Brown, DPM and Scott Orthopedic Center Inc. alleging professional malpractice.
According to the complaint, the plaintiff alleges that on March 5, 2010, he presented to defendants for a triple arthrodesis procedure of his left foot. He alleges Brown deviated from the standard of care by performing the procedure, which was not indicated, resulting in the nonunion of talonavicular and calcaneocuboid joints.
The plaintiff alleges he did not discover the injuries or damages until in or after April 2016.
The plaintiff holds Brown and Scott Orthopedic Center Inc. responsible he allegedly sustained severe and permanent injuries because of the defendants' negligence.
The plaintiff requests a trial by jury and seeks compensatory and punitive damages, plus interest, costs and such other appropriate relief. He is represented by Ben Salango and Patrick J. Salango of Preston & Salango PLLC in Charleston.
The case has been assigned to Circuit Judge Christopher D. Chiles.
