Boll Medical alleged to owe Drive Medical for goods ordered and delivered

CHARLESTON – A Charleston company is alleged to owe more than $29,000 for goods it ordered from a New York business.

Drive Medical SPV LLC filed a complaint in Kanawha Circuit Court against Boll Medical Inc. and Derrick J. Green alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiff alleges that it sold and delivered goods to Boll Medical on credit that the purchases were guaranteed by Green. The plaintiff alleges the amount of $29,625.29 remains due and owing for the goods. 

The plaintiff holds Boll Medical Inc. and Green responsible because the defendants allegedly have failed and refused to pay the amount.

The plaintiff seeks judgment against the defendants in the amount of $29,625.29, plus continuing interest of 18 percent per annum from Oct. 26, 2017, attorney's fees, costs and such other just and proper relief. It is represented by John R. Keating of Amato Keating and Lessa PC in Bethlehem, Pennsylvania.
