Customer alleges gas station failed to provide safe walkway

LOGAN — A customer is suing a fuel company, alleging negligence caused her to fall at a Logan County gas station.

Bessie Bostic filed a complaint in Logan Circuit Court against Speedway LLC, doing business as Rich Oil Company, alleging the defendant failed to provide a safe ingress and egress to the store for its customers.

According to the complaint, on July 24, 2016, Bostic traveled to the Rich Oil store on Holden Road in Shamrock to purchase fuel. The suit says Bostic tripped and fell on the metal lids to the fuel storage tanks that house Rich Oil's petroleum products. 

As a result, Bostic says she suffered physical injuries and incurred medical bills of $6,500. 

The plaintiff alleges Rich Oil failed to provide a pavement free of cracked and deteriorated concrete for a safe walkway for customers.

Bostic seeks trial by jury, damages, interest on all out-of-pocket expenses, and all other proper relief. She is represented by attorney Mark Hobbs of Chapmanville.
