Charleston homeowner alleges contractor failed to do proper work

CHARLESTON — A Charleston homeowner is suing contractors, alleging breach of contract.

Maria Marsha Poffenberger filed a complaint in Kanawha Circuit Court against Alex Kimble and Above It All Construction & Repairs LLC, alleging they failed to perform work in a good and workmanlike manner.

According to the complaint, the parties entered into a contract in which the defendants would construct Poffenberger's residence in Charleston. As a result of the defendants' reckless and negligent work, the suit says, Poffenberger's home was never completed and she will suffer additional expenses to repair the damages. 

The plaintiff alleges that despite her request to repair the damage and complete to project, Kimble and Above It All Construction & Repairs failed and refused to do so.

Poffenberger seeks trial by jury, judgment to repair the damage to her residence, compensatory damages, attorney fees, court costs and all other proper relief. She is represented by attorney Charles M. Love of The Love Law Firm PLLC in Charleston.
