Customer alleges National Tire negligence caused vehicle to crash

CHARLESTON — A Kanawha County customer is suing National Tire, alleging unlawful sales.

Nia Pholwattana filed a complaint in Kanawha Circuit Court against National Tire and Battery. alleging violation of the West Virginia consumer protection statutes.

According to the complaint, on March 19, Pholwattana brought her 2010 Chevrolet Malibu to National Tire in Dunbar to check on the brakes. The suit says the defendants failed to pump the brakes back into place.

The lawsuit states when Pholwattana started to drive the car out of the repair shop, she lost control of the vehicle, causing the car to run over the curb backard at full speed.

The suit alleges Pholwattana's vehicle, as well as another vehicle in the neighboring parking lot, were damaged. The plaintiff alleges National Tire and Battery responsible failed to pump up the vehicle's brakes back into place before moving it.

Pholwattana seeks trial by jury, compensatory damages, attorney fees, court costs and all other just and proper relief. She is represented by attorney Michael M. Cary of Cary Law Office PLLC in Charleston.
