Customer alleges Kroger's negligence caused him to slip on peas

MOUNDSVILLE — A Marshall County man is suing Kroger, alleging negligence caused him to fall.

Jeffrey S. Blake filed a complaint in Marshall Circuit Court against Kroger Limited Partnership I, alleging failure to maintain its premises in a reasonably safe condition.

According to the complaint, on July 30, 2016, Blake was shopping at the Kroger store in Moundsville when he slipped and fell on a pod of peas lying on the floor. He says he sustained serious and permanent injuries and was caused medical expenses, pain and suffering, mental anguish and loss of ability to enjoy life. 

The plaintiff alleges Kroger Limited Partnership I failed to clean up the peas on the floor and failed to warn invitees of the danger.

Blake seeks damages sufficient to compensate for his injuries, pre- and post-judgment interest, court costs and all other just and proper relief. He is represented by attorney Adam E. Barney of Berry, Kessler, Crutchfield, Taylor & Gordon in Moundsville.
