Virginia motorist alleges truck business' negligence caused crash

WINFIELD — A Virginia man is suing a truck business and an employee, alleging negligence caused a crash that injured the plaintiff.

Daniel Hubert Rose Jr. filed a complaint in Putnam Circuit Court against Beam Bros. Trucking Inc., Cross Key Leasing Inc. and Geremi Joseph Cappelletti, alleging Cappelletti negligently drove a 2012 Volvo tractor truck owned by Beam Bros and Cross Key.

According to the complaint, on Oct. 12, 2016, Rose was driving a 2017 Volvo tractor truck southbound on U.S. Route 35 in Putnam County. The suit says Cappelletti, in the course and scope of his employment with Beam Bros. and Cross Key, caused the truck he was driving to collide with the rear of Rose's vehicle. 

Rose says he sustained injuries resulting in medical expenses, pain and suffering, emotional distress and loss of enjoyment of life. The plaintiff alleges Cappelletti failed to keep proper lookout, failed to maintain safe distance and failed no maintain a reasonable speed.

Rose seeks trial by jury, compensatory damages, pre- and post-judgment interest, attorney fees and expenses and all other proper and appropriate relief. He is represented by attorney Shawn R. Romano of Romano & Associates PLLC in Charleston.
