Change of slope in ramp at Cedar Grove Furniture alleged to have caused customer's fall

CHARLESTON – A power of attorney alleges that a shopper at a Kanawha County furniture store was injured in a fall caused by a ramp.

Martha Hewitt, power of attorney for Sandra Hewitt, filed a complaint in Kanawha Circuit Court against Cedar Grove Furniture Co. alleging negligence.

According to the complaint, on Feb. 7, Sandra Hewitt was a business invitee at defendant's premises with the intent of shopping when she fell because of the slope difference of a second ramp she encountered in the showroom. The suit states Sandra Hewitt sustained a broken arm and head injury as a result of the fall.

The plaintiff holds Cedar Grove Furniture Co. responsible because the defendant allegedly failed to place a hand rail along the ramp and failed to warn of the change in slope.

The plaintiff requests a trial by jury and seeks judgment in an amount sufficient to compensate for the damages, plus costs, attorney's fees, pre- and post-judgment interest, and all other relief the court deems just and proper. She is represented by Scott H. Kaminski of Kaminski Law PLLC in Charleston.

The case has been assigned to Circuit Judge Joanna Tabit.
