Ford customer alleges dealer sold defective vehicle

CHARLESTON — A Kanawha County customer is suing a Charleston Ford automobile dealer, alleging breach of contract and negligent misrepresentation.

Paige Cotsmire filed a complaint in Kanawha Circuit Court against Bert Wolfe Ford in Charleston, alleging the defendant made unlawful sales practices in violation of West Virginia Consumer Protection statutes.

According to the complaint, on Feb. 3, 2015, Cotsmire purchased a new 2014 Ford Focus from Bert Wolfe Ford. The suit says throughout the past three years, Cotsmire has experienced numerous issues with the vehicle, most concerning the shuddering of the transmission. 

The lawsuit states the plaintiff has brought the Ford Focus into Bert Wolfe for repair on three separate occasions for ongoing transmission shuddering that recently became so severe that she no longer feels safe driving the vehicle. Furthermore, Cotsmire says the ongoing issues with vehicle were not corrected by the defendant as required in the contract in which she has has invested so much money and time. 

The plaintiff alleges Bert Wolfe Ford made unfair and deceptive acts in providing Cotsmire a vehicle unfit for its intended purposes.

Cotsmire seeks trial by jury, compensatory damages with attorney fees, court costs, and all other just and proper relief. She is represented by attorney Michael M. Cary of Cary Law Office, PLLC in Charleston.
