Patient accuses Ohio Valley Medical Center of negligence

WHEELING — A Wetzel County patient is suing a Wheeling hospital operator, alleging negligence caused the plaintiff to topple from her wheelchair.

Joyce A. Nice filed a complaint in Ohio Circuit Court against Ohio Valley Medical Center Inc., alleging failure to provide handicapped-accessible parking spaces.

According to the complaint, on Jan 3, 2017, Nice was injured when an Ohio Valley Medical Center wheelchair Nice was sitting in became stuck on a curb. As an employee attempted to dislodge it, the suit says, the wheelchair tipped, throwing Nice face down to the cold and wet cement.

Th lawsuit states Nice hit her right elbow, shoulder and knee, and temporarily lost consciousness. The plaintiff alleges Ohio Valley Medical Center's employee did not allow Nice to use her own wheelchair and insisted that she utilize the defendant's wheelchair.

Nice seeks trial by jury and compensatory damages that are fair, just and equitable. She is represented by attorneys Christopher M. Turak and Michelle L. Marinacci of Gold, Khourey & Turak LC in Moundsville.
