Nitro man accuses used car dealership of breach of contract

CHARLESTON — A Nitro man is suing a Charleston used automobile dealership, alleging breach of warranty.

Charles Joseph Evans filed a complaint in Kanawha Circuit Court against Noel's Used Cars, alleging violation of the West Virginia Consumer Protection Act.

According to the complaint, on March 29, Evans purchased a 1998 Ford Mustang from Noel's Used Cars for $5,391. Upon the purchase, Evans says he noticed a problem with the rear differential. 

To date, the suit says, the rear differential continues to make significant noise. The plaintiff alleges Noel's Used Cars has failed to fix the noise with the rear differential and has continued to ignore Evans' request to have the problem fixed.

Evans seeks trial by jury, all damages, plus interest, court costs and expenses and all other just and proper relief. He is represented by attorney Joshua R. Martin of The Martin Law Firm in Nitro.
