Former member of behavioral medicine group alleges new owner breached contract

CHARLESTON — A Kanawha County man is suing a Mason County health care clinic, alleging fraud and inducement.

Joshua Andrew Angel filed a complaint in Kanawha Circuit Court against New Life Clinics and clinics president James T. Bowen, alleging they fraudulently induced the plaintiff to enter into a contract without any intention to adhere to its terms and conditions.

According to the complaint, in October 2016, New Life Clinics executed a buyout of Southern Behavioral Medicine for $60,000 and granted that Angel would receive 5 percent equity in New Life. However, the suit says, as a result of the defendants' conduct, Angel suffered economic harm for not receiving either full payment for the said amount or his 5 percent interest in the business. 

The plaintiff alleges New Life Clinics and Bowen, after making the initial payment of $3,000, have ceased to make any further payment on the remaining balance and have failed to convey Angel's 5 percent equity interest in New Life.

Angel seeks trial by jury, damages to be determined at trial, attorney fees, costs and all other just and appropriate relief. He is represented by attorney Travis A. Griffith of Griffith Law Center PLLC in Charleston.
