Kanawha Co. man alleges he received unsolicited text, calls

CHARLESTON — A Kanawha County man is suing a New York finance company, alleging telephone harassment.

Gordon C. Lane, Jr. filed a complaint in Kanawha Circuit Court against Shore Funding Solutions Inc., of Patchogue, New York, alleging violation of the West Virginia Consumer Credit Protection Act.

According to the complaint, between Aug. 2, 2016, and Feb. 20, 2017, Lane began receiving calls and text messages from Shore Funding to his cellular telephone number despite his being listed on the DNC Registry since 2016. 

Lane says Shore Funding used an auto-dialer to place each call, causing the defendant's true telephone number to be obscured. Furthermore, despite the plaintiff's request to stop contacting him, the lawsuit states, Shore Funding continued to call at least five more times, causing annoyance, inconvenience and harassment. 

The plaintiff alleges Funding Solutions failed to honor the DNC Registry by initiating telephone solicitations to Lane's telephone and by continuing to contact the plaintiff without prior express written consent.

Lane seeks trial by jury, statutory and actual damages, cost of litigation and all other necessary and proper relief. He is represented by attorney Gordon C. Lane Sr. of Lane & Young in Charleston.
