Family member alleges medical facility's negligence caused death

PRINCETON — A family member is suing a medical facility, alleging negligence caused the death of a patient.

Jennings Berry, as administrator of the estate of Gregory Lyn Berry, filed a complaint in Mercer Circuit Court against Rehabilitation Hospital Corporation of America LLC, doing business as HealthSouth Southern Hills Rehabilitation Hospital, alleging breaching the professional standards of care and treatment.

According to the complaint, from May 4-19, 2016, Gregory Lyn Berry, was under the care of HealthSouth Southern Hills Rehabilitation Hospital in Princeton, West Virginia. The suit says he had a large deep tissue injury.

However, the lawsuit states, Berry was discharged May 19, 2016, with basic wound and catheter instructions despite having shown signs of mental/psychological deterioration and a worsening wound condition.  The suit says Berry was transferred to another medical facility but eventually died June 8, 2016, as a result of HealthSouth Southern's negligence in the proper diagnosis, care and treatment of the decedent. 

The plaintiff alleges HealthSouth Southern Hills Rehabilitation Hospital failed to properly monitor, assess and treat Gregory Lyn Berry and failed to provide adequate guidance and training to its hospital staff.

Jennings Berry seeks trial by jury, compensatory and punitive damages, plus costs. He is represented by attorneys Stephen P. New and Amanda Taylor of Beckley.
