WAYNE — Two Wayne County residents are suing Chase Bank, alleging intentional infliction of emotional distress, and violation of the West Virginia Consumer Credit and Protection Act.
Ronnie Lee Stumbo and Ethelene Stumbo filed a complaint in Wayne Circuit Court against Chase Bank USA NA and Chase Card Services, alleging they violated WVCCPA through intrusive and unwanted phone calls.
According to the complaint, the Stumbos had to endure stress, anxiety and annoyance as a result of the volume and consistency of phone calls from agents of Chase in attempts to collect on a debt. The suit says the calls continued despite Chase being informed that the plaintiffs are represented by an attorney.
The plaintiffs allege Chase Bank USA and Chase Card Services inflicted emotional distress upon the Stumbos to coerce them to pay money, and called them without prior express consent at such frequency as meant to abuse or harass.
The Stumbos seek trial by jury, general and punitive damages and all other proper relief. They are represented by attorneys Matthew P. Stapleton and Scott G. Stapleton of Stapleton Law Offices in Huntington.
