Employee alleges VFW post violated wage payment act

CHARLESTON — A Harrison County man has filed a class action lawsuit against a Bridgeport VFW post, alleging violation of the Wage Payment and Collection Act.

Troy Evans filed a complaint on behalf of himself and all others similarly situated in Kanawha Circuit Court against Meuse-Argonne Post 573 Veterans of Foreign Wars of the United States Inc. and Veterans of Foreign Wars of the United States Inc., alleging failure to compensate employees proper wages and benefits.

According to the complaint, Evans and other similarly situated employees have suffered lost earnings from the defendants' wrongful practice of denying class members earned wages for all hours worked, and retaliated against Evans by terminating his employment for his complaints about improper salary. 

The plaintiff alleges the defendants failed to pay Evans and class members their proper wages in a timely manner, and failed to pay all hourly wages and overtime.

Evans seeks trial by jury, award all wages due, interest, liquidated damages, court costs, attorney fees and all other just relief. Evans and the class are represented by D. Adrian Hoosier II of Hoosier Law Firm PLLC in Charleston.
