Customer alleges Wal-Mart negligence led to fall in Cross Lanes store

CHARLESTON — A Kanawha County woman is suing Wal-Mart, alleging negligence led to injuries to the plaintiff.

Andrea Oxley-Price filed a complaint in Kanawha Circuit Court against Wal-Mart Stores East LP, Walmart Store No. 2576 and Home City Ice, alleging the defendants failed to make sure the premises were safe for the public.

According to the complaint, on Aug. 15, 2016, Oxley-Price was at the premises of a Wal-Mart in Cross Lanes when she slipped on water on the floor near the Home City Ice display. Oxley-Price says the slippery condition caused her to fall, causing serious and permanent injuries. 

The plaintiff alleges the defendants failed to maintain and remove water on the floor to avoid a slipping hazard and failed to warn customers of the hazardous condition.

Oxley-Price seeks trial by jury, special, general and punitive damages, prejudgment interest, costs of action and all other just and proper relief. She is represented by attorney Kevin P. Davis of Charleston.
