CHARLESTON — A Boone County man is suing South Charleston medical facility, alleging medical negligence and sexual assault.
Walter Wilson filed a complaint in Kanawha Circuit Court against Herbert J. Thomas Memorial Hospital Association, doing business as Southway, and Luther Samuel Brown III, alleging violation of the West Virginia Human Rights Act.
According to the complaint, on Oct. 18, 2017, Walter Wilson entered a 28-day rehabilitation treatment program at Southway. The suit says Wilson was sexually harassed by Brown numerous times.
Wilson says Brown grabbed him in the buttocks, asked the plaintiff to perform oral sex on him, offered favors in exchange for sexual relations and threatened to get the plaintiff kicked out of the facility if he told anyone. As a result, Wilson alleges he sustained injuries, emotional distress, humiliation and mental anguish.
The plaintiff alleges Southway and Brown failed to stop the repeated sexual abuse, inappropriate and offensive sexual requests, sexual comments and sexual innuendo by Brown.
Wilson seeks trial by jury, judgment for intentional and reckless misconduct, plus compensatory and punitive damages. He is represented by attorneys Ben Salango and Kristina M. Salango of Preston & Salango PLLC in Charleston.
