CHARLESTON — A Boone County couple is suing Charleston and a county commission, alleging negligence and violation of the city ordinance.
Carolyn Moore and George Moore filed a complaint in Kanawha Circuit Court against the City of Charleston, the Kanawha County Commission and John Doe, alleging they negligently maintained a city sidewalk, leaving it in a state of disrepair, damaged and/or uneven.
According to the complaint, on Aug. 15, 2016, Carolyn Moore was walking along the sidewalk near the Kanawha County Courthouse Annex Building when she tripped and fell. The suit says she suffered severe injuries, including but not limited to a fracture of the left radius head, a tear of the anterior horn of the left lateral meniscus and contusions.
The plaintiffs allege the defendants failed to remediate the sidewalk and maintain it in good and proper repair.
The Moores seek trial by jury, judgment against the defendants, jointly and severally, in an amount exceeding the jurisdictional limits of the court, with interest, attorney fees, costs and disbursements, and all other just and proper relief.
