CHARLESTON — A licensed insurer is suing a Kanawha County company, alleging breach of contract and unjust enrichment in failing to pay nearly $5,800.
BrickStreet Mutual Insurance Company filed a complaint in Kanawha Circuit Court against M-Rock Inc., alleging the defendant has been in default of the terms of the policy.
According to the complaint, between Nov. 1-Dec. 3, 2017, BrickStreet provided workers' compensation and employer's liability insurance to M-Rock for $5,987.50. After receiving payment of $200.50 in March 2018, the suit says, the principal balance of $5,787.50, remains unpaid.
The plaintiff alleges M-Rock failed to pay the scheduled monthly payments beginning in April 2018.
BrickStreet Mutual Insurance seeks trial by jury, judgment of $5,787.50, plus court costs, attorney fees, interest and all other proper and just relief. It is represented by attorneys Arnold J. Janicker and Steven P. Turner of Jenkins Fenstermaker PLLC in Huntington.
