Former patient accuses health care data provider of breach of confidentiality

CHARLESTON — A Logan County woman is suing a Charleston health care data provider, alleging invasion of privacy and negligence.

Elizabeth Fry filed a complaint in Kanawha Circuit Court against Molina Information Systems LLC, doing business as Molina Medicaid Solutions, alleging the defendant negligently allowed a third party to access the plaintiff's medical record without her knowledge or authorization.

According to the complaint, at a certain time known to both parties, a Molina employee approached Frey, who is terminally ill, regarding her medical condition. As a result, Fry says, she has suffered emotional pain and suffering, mental anguish and distress, humiliation and embarrassment. 

The plaintiff alleges Molina Medicaid Solutions failed not to disclose and not to disseminate Fry's confidential medical information to third parties.

Fry seeks trial by jury, judgment in an amount to be proven at trial, plus interest, attorney fees, court costs and expenses and all other just and proper relief. She is represented by attorney Alan L. Pritt of Pritt & Spano PLLC in Charleston.
