Legal guardian alleges Kanawha school board negligence led to child's injuries

CHARLESTON — A Kanawha County man is suing the local board of education and employees, alleging negligence and vicarious liability caused injuries to a minor on a school bus.

P.H. a minor and through her legal guardian Timothy Hager, filed a complaint in Kanawha Circuit Court against the Kanawha County Board of Education, Alum Creek Elementary School principal Beth Hoylman, John Doe and Jane Doe, alleging they failed to follow applicable safety guidelines and regulations.

According to the complaint, on Nov. 20, 2017, the minor child, while riding a school bus, was subjected to bullying by other students on the bus while under the care of the Kanawha County Board of Education. The suit says the child was slammed into the window of the bus, lost two of her front permanent teeth, and suffered physical and emotional injury and damages. 

The plaintiff alleges the defendants failed to properly contact the minor's guardian immediately after the incident, failed to provide adequate medical attention, and failed to provide adequate supervision and a safe and suitable environment free from harassment.

Hager and P.H. seek trial by jury, compensatory and punitive damages, interest, attorney fees, court costs, expenses and all just relief. Hager is represented by attorney Joseph H. Spano Jr. of Pritt & Spano PLLC in Charleston.
