WARNER LAW OFFICES PLLC: Alleged Surgical Errors involving Eye Spark $2.25 million lawsuit

Mlm

Warner Law Offices PLLC issued the following announcement on Oct. 4.

A woman in another state recently claimed that a botched surgery caused her to lose her eyesight. She has thus filed a lawsuit against a health care organization as well as the nurse who reportedly caused her vision loss. Individuals in West Virginia who likewise suffer the negative consequences of surgical errors may choose to seek justice through the civil court system.

The woman in the out-of-state case asserted that she underwent eye surgery back in 2016. As part of the procedure, a vitrectomy was performed on the woman's right eye, which involved removing transparent tissue located behind her lens. A surgeon and the nurse who assisted the surgeon also performed a cataract extraction and membrane peel.

After the procedure, the nurse reportedly made mistakes when trying to help to apply gauze to the patient's eye. For instance, she allegedly pressed her thumb into the patient's eye. The plaintiff claimed that his caused her to suffer hemorrhaging, a tear and retinal detachment, and as a result, she lost both depth perception and her peripheral vision. She is seeking $2.25 million as part of her lawsuit.

Surgeons in West Virginia are expected to exercise a reasonable degree of care when performing procedures on patients. Unfortunately, sometimes, they fail to operate in accordance with this standard, and when this happens, patients may end up suffering serious harm. Fortunately, patients who fall victim to surgical errors have the right to seek damages through a liability lawsuit. Competent proof of negligence is necessary to establish liability in such a claim, as only then will a judge decide claims for financial damages. A monetary award may help with covering ongoing health care costs and other losses stemming from a documented medical malpractice incident.
