Patron alleges Beaver bar owners' negligence led to assault

BECKLEY — A patron is suing Beaver bar owners and a co-patron, alleging negligence led to an assault on the plaintiff.

Jesse Allen Sampson filed a complaint in Raleigh Circuit Court against Alice's and More, K&K Music Company and Jerry Calvin Sweeney, alleging that Alice's and K&K failed to ensure the safety of their patrons inside their premises.

According to the complaint, on Aug. 26, 2016, Sampson was a patron of Alice's in Beaver when he was attacked and assaulted by Sweeney. Sampson says he sustained a broken leg and has incurred significant medical expenses, pain and suffering, mental anguish and emotional distress. 

The plaintiff alleges Alice's and K&K negligently provided alcoholic beverage to Sweeney and allowed him to remain on the premises with full knowledge of his prior violent behavior.

Sampson seeks trial by jury, all damages, plus costs, disbursements and attorney fees, and all other just and proper relief. He is represented by attorney Christopher D. Lefler of Lefler Law Office in Beckley.
