Nursing home sued after resident suffers injuries

CHARLESTON — An estate administrator has filed a lawsuit against a Kanawha County facility, claiming it didn't provide proper care to a former resident.

Pauline Tomaszewski, the estate administrator for Richard J. Tomaszewski Sr., filed a complaint in Kanawha Circuit Court against St. Albans Operating Co., doing business as the Riverside Health and Rehabilitation Center, as well as several Savaseniorcare companies.

She is alleging that the defendants breached their duty to provide adequate and appropriate health care and protective support service to all residents.

Pauline Tomaszewski claims that between October and December 2017, Richard J. Tomaszewski fell down several times and suffered pressure sores while a resident of Riverside Health and Rehabilitation.

She alleges the defendants failed to properly staff the facility, failed to provide proper supervise Richard J. Tomaszewski and failed to provide basic needs of food, liquid, toileting, cleaning and cleaning assistance.

The plaintiff requests a trial by jury and seeks judgment for damages, punitive damages as well as any other relief that the Court sees fit to award. She is represented by Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart | Bell PLLC in Charleston.
